Be Thorough About Damage Reporting After a Car Accident

An experienced Cerritos car accident lawyer will tell you that if you get into a car crash, you need to be very clear about the damages and losses you sustained if you expect to be fairly compensated by an insurance company. Before going into detail, a brief overview of car accidents in Cerritos, California may shed some light on just how often such losses occur.

Car Accidents in Cerritos Reflect Mounting Tragedies

Statistics compiled by the California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS) showed that in 2006, five people lost their lives and 434 people were injured in Cerritos car crashes. Seventeen pedestrians were injured. One bicyclist died and five were injured. Motorcycle accidents killed two and injured 18. Additionally, DUI crashes resulted in three deaths and 21 injuries. In 2007, five car accidents resulted in five fatalities. In 2008, three car crashes ended in three deaths.

Ask a Car Accident Lawyer to Help You Compile a List of Damage Claims

Some of today's most experienced Cerritos car accident lawyers often advise their clients who have been in a car crash to make a detailed list of every item that qualifies for reimbursement. This should be included in the letter of damages that you submit to an insurance adjuster. Regrettably, most car accident victims try to settle their property damage claims on their own, without first consulting a car collision lawyer. This is the exact opposite of what car crash lawyers recommend. Many car accident victims are overwhelmed by their accident and only consider the loss of their vehicle. They often forget CD and DVD players, expensive navigation systems, custom wheels and other aftermarket accessories that can run into thousands of dollars.

If the car was a Porsche, high-end Mercedes or other expensive vehicle that had to be repaired, these vehicles take a huge hit in resale value. The thing to remember is that insurance companies are in no way motivated to fully reimburse you for your damages. In fact, once you sign a release of property damage claims, you can't claim any more items later. The same holds true for the drop in value of a repaired vehicle you previously failed to mention. The insurance company is done. Case closed.

How Long Does it Take to Settle a Car Accident Case?

Many victims wonder how long does it take to settle a car accident case especially if they have been injured or have experienced loss of property and need financial help immediately. Many things can happen as a result of a car accident such as a disability, vehicular damage, loss of job or even death. Those who have experienced some loss that requires immediate help are the most desperate to know how long does it take to settle a car accident case. Here are some basic guidelines in determining the length of time you can expect regarding vehicular accident case settlements.

1. Circumstances of Accident - As with any law case, the circumstances will determine the length of time and amount of energy necessary to resolve the issue. The more complicated the situation, the longer a case generally requires. If you are involved in a simple case that is clearly the other driver's fault as determined by law enforcement and the driver does not challenge the assessment, you may see your case settled within a few weeks. A more complicated case that involves issues such as drunk driving, death or disability claims can require a lot more time and you can expect to be involved for several months or even a couple of years before it is resolved legally and financially.

2. Attitude of the Insurance Company - Another issue that can make a case shorter or longer is the attitude of the liable insurance company. If they refuse to settle in short order or decide to prolong the case by throwing up every paper thin issue they can find, you may be dealing with them for several months before every protest is met. On the other hand, a reputable insurance company that puts consumer interests first will usually settle a case within a few weeks rather than spend extra time and money on a prolonged case.

3. Ability of Your Counsel - The attorney that you choose will play an important part in whether or not your case is resolved successfully as well as in a shorter amount of time. When choosing a competent lawyer, be sure that you choose one that listens to you, that has handled several cases similar to yours and that has a success rate in dealing with car accident cases. An experienced attorney who handles mostly accident cases will do a much better job, generally speaking, than another lawyer who only handles these types of cases once in a while.

4. Your Patience - Some clients are so desperate to get a case settled that they will take an early settlement that may not be as much as they could ultimately receive if they relied on their legal counsel's best advice. Some unscrupulous insurance companies will offer a meager settlement to desperate victims in order to protect their bottom line. If you have confidence in your legal advisor, be sure to exercise patience in waiting on the best settlement you can receive.

Be sure to keep these issues in mind if you are involved in any car accident suit so that you know what to expect. If you know realistically how long does it take to settle a car accident case, you won't be as apt to make a poor decision that could negatively impact your future.

If people are injured make notes about this. If you believe that the driver at fault was under the influence of drugs or drinks then make a note of this. Make a note of your own injuries as well. Teenage Car Accidents - Understanding the Risks and Dealing With It

Teenage car accidents are considered as one of the greatest dangers teenagers who drive face. If you have a teenage son or daughter, make sure that you as well as your teenage child understand the risks of teenage car accidents. The statistics show that car accidents involving teenagers are very common, and every day, factors that heighten the possibilities of these car accidents pile up.

Drunk driving, driving during the night, driver distraction from passengers, cellular phones, and mp3 players all contribute to the dangers that put teenagers at risk of getting into car accidents while driving. And since these young drivers are still inexperienced, the risks are affected by aggravating factors way faster.

The Risks According to the Statistics

Some parents and most teenagers may take the risks of teenage car accidents for granted. Unfortunately, that's one of the most dangerous things you can do. If you are unaware, check out the stats of teenage car accidents to fully understand the dangers you're facing.

According to statistics, more than 400,000 teens between 16 and 20 are severely injured in auto accidents, and more than 5,000 lose their lives. Despite the very small percentage (10%) of the population that teenagers account for, teenage car crashes actually account for 12 percent of fatal car accidents. In other terms, teenage auto accidents are behind 26 billion dollars worth of car accidents, which is 30% of all costs associated with auto accidents in the entire country.

The large number of teenage accidents can be attributed to naturally higher risks of young drivers getting into an accident. A teen driver aged 16 to 20 is four times more likely to get into an accident than other drivers. This risk climbs during the first year that a teen is able to drive.

What to Do After a Teenage Auto Accident

Get the facts

If you are a parent and your teenager has just gotten into an accident, the first thing to do is get the facts. Before you reprimand your teenager or defend him/her from other parties involved, make sure you know what really happened. Give your teenage driver the benefit of the doubt. Run your teenager's statement through the police present to report on the accident so you can get a clear view of the accident.

Call a auto accident lawyer

It would help to have some legal help on your side in case you need to make a claim or you and your teenage driver need to face damage claims from other parties involved in the accident.

Educate your child about safe driving

After the accident, make sure to reiterate to your child once again just how dangerous driving is and how it should be taken seriously. Never get tired of warning and reminding your child in order to ensure his safety and that of other motorists on the road. Also, don't forget to give special warning against drunk driving, which has led to some of the most severe and most fatal car crashes involving teenagers.

Can you prevent teenage car crashes?

Just as you can't fully control the behavior of your teenagers, you cannot prevent teenage car crashes. The possibility of one occurring still lies in the hands of your teenage driver. However, you can do your best to lessen the dangers that threaten their lives by always reminding them to become responsible drivers.

Do: Do your part; call up your teenager's friends and their parents and talk to them about the need to reinforce road safety and responsible behavior. Get car insurance for your teenager so you can be saved from a lot of trouble and expense in case teenage car accidents do occur.
Don't: Don't treat your teenager like a small child. Make him understand the real dangers of teenage car accidents.

The Verdict: Teenagers are now being threatened by a lot of dangers while on the road, and most of these dangers, such as over-speeding, drunk driving, and reckless driving, can actually be controlled. What's important is that your teenage driver understands the danger, and your role as the primary educator makes a big difference.

If You Are Injured in an Auto Accident, Call an Auto Accident Lawyer

There are more and more auto accidents occurring on highways all over the world everyday, and the numbers keep rising. Many lives have been stolen thanks to auto accidents, and even more people seriously injured, oftentimes, due to something that could have easily been avoided.

Insurance companies are paying out money faster than ever before, and all of our premiums are rising due to that fact. Of course, where our wallets are the only thing affected, victims of auto accidents often have to deal with long-term pain, debilitating injuries, loss of work, or job loss altogether, and extreme mental anguish due to their physical and financial situations, often caused by meeting a reckless driver on the road.

If you or someone you love is injured by the fault of another driver, then you have the legal right to sue both the person who owns the automobile, and that person's insurance company as well. To get the best chances of winning and getting the most from your claim, you should seek the advice of a professional accident lawyer, who can tell you exactly how winnable your case is, and how you need to proceed. If nothing else, you will likely have your medical costs paid for, so that you aren't faced with overwhelming medical debt through no fault of your own. Your accident lawyer may even be able to force the insurance company to reimburse you for your loss of income.

Some auto accidents are caused by malfunctioning vehicles, such as faulty brakes, bad tires, etc, while far too many are caused by other drivers, due to either being under the influence of drugs and alcohol, fatigue, error, or reckless driving. If the auto accident is proven to be caused by a faulty vehicle part, then the car owner can sue the producer of that particular vehicle for poor workmanship. The auto accident lawyer is dedicated to getting you the financial compensation you deserve for being injured by someone else's hand, whether due to vehicle issues, or just poor judgment.

Many insurance companies try to offer victims settlement payments to try and avoid going to court, especially if they feel they have little chance of winning. Many victims unfortunately fall for this, and end up with very little money, when it is all said and done. Some even go so far as to talk victims out of seeking compensation, making them feel as though they are wrong for doing so. Professional, caring lawyers know how to deal with these companies, and will handle everything on your behalf, so that you don't have to deal with these scheming, often rude insurance agents and adjustors.

Tips on How to Prepare For Your Meeting With a Car Crash Lawyer

You are about to have your first meeting with an experienced, highly competent car crash lawyer about a potential personal injury claim. By keeping in mind that the lawyer will use the meeting to assess you and your potential claim, you will be able to prepare in a way that leave the right impression with the lawyer and makes it more likely that he or she will agree to represent you.

First, get organized. The lawyer will need certain documents from you in order to evaluate your potential claim. Put together a folder with the following documents before your meeting:

1. The police report and/or accident report(s). These reports will help the lawyer get additional descriptions of the accident, determine the identity of any witnesses and their view of how the accident happened and who is at fault, find out about any special circumstances such as alcohol, and whether anyone was cited for the accident.

2. Photographs of the accident and accident scene. The photographs will help the lawyer get a sense of the accident scene and (if the photographs were taken at the time of the accident) the amount of traffic, visibility, and weather conditions.

3. All information you gathered regarding the other driver, including name, address, driver's license number, vehicle year, make and model, license plate number, and insurance company. The lawyer will need to identify the other driver to find out as much about the driver as possible, including whether (and how much) insurance the driver has, and whether the driver has been involved in other accidents.

4. The names and contact information of any witness(es) to the accident. Witnesses can be very helpful in establishing who is at fault for the accident. The lawyer will want to determine whether all the witnesses give a similar account of the accident and whether they are credible.

5. Photographs of damage to the vehicle(s) involved in the accident and estimates (or bills) of repair costs. The lawyer will also be able to gauge the location and extent of the damage to the vehicles involved. All too often insurance adjusters handling car crash cases judge the claim of injuries by the extent of damage to the vehicles. They, and potential jurors, tend to look at serious injuries in cases involving minor damage to the vehicles suspiciously. While there are many severe injuries that can be sustained in cases involving low impact or minor vehicle damage, the lawyer will need to determine how much resistance may be posed by claims adjusters and potential jurors.

6. Photographs of any injuries you suffered as a result of the accident. For injuries that are visible, such as hematomas, fractures, cuts and resulting scarring, photographs are the best way to relate the severity of the injury. It may also be possible to use photographs can also be used to show the progress of your treatment.

7. All medical records concerning the diagnosis of the injuries you suffered as a result of the accident and of the treatment you have undergone for those injuries. These records will help your lawyer determine the extent of your injuries, your treatment for those injuries, and the cost of the treatments. In certain cases, the injuries may require long term, or even life-long treatment. In such cases, the lawyer will ask your doctors for documentation of the need for future treatments.

8. Documentation regarding any lost wages (or loss of earning capacity) and other costs you incurred as a result of the accident. These are compensable losses.

9. Your automobile insurance policy. The lawyer will need to determine all sources of potential insurance coverage for your claim in case the driver at fault is uninsured or underinsured. If your value of your claim is likely to exceed the insurance available from the other driver and you have greater coverage from your own uninsured/underinsured section of your policy, your lawyer may be able to access your policy for additional coverage.

In addition, you should also put together a list of all prior personal injury (or other legal claims) you have made and a description of any relevant medical history. Insurance companies keep track of all such claims and may use information about such claims in valuing your current claim. Both insurance adjusters and defendant's lawyers will try to use the existence of prior claims and prior similar injuries to reduce the value of your current claim.

By being well prepared for your initial meeting, you will demonstrate to the lawyer that you are responsible, organized, and dependable. Along the way be sure you courteous to the lawyer's staff, been easy to reach and return phone calls promptly, be punctual, and have reasonable expectations. This is important for top car crash lawyers who have the luxury of turning down cases involving clients who may prove difficult to work with.

If the lawyer decides to further investigate or to pursue the claim on your behalf, the lawyer will likely ask you to sign a medical release form to obtain copies pertinent medical records. The lawyer will also likely ask you to sign a retainer agreement. In personal injury cases, these are also often referred to as a Contingency Fee Agreement because lawyers who handle personal injury matters normally take them on contingency rather than on an hourly basis, meaning the lawyer will be paid only if there is a recovery in which case the lawyer's fee will be a percentage of that recovery. The agreement will likely contain a provision allowing the lawyer to withdraw as your lawyer if additional information leads the lawyer to reevaluate the claim. If you wish for this lawyer to handle your claim and sign the agreement, the lawyer can then begin to work on the case.

Selecting an experienced, competent car crash lawyer can make a significant difference in the outcome of your case. Keep in mind that the law limits the amount of time you have to pursue a claim.

Critical Car Accident Mistake #5 - You Did Not Hire a Lawyer Or Did Not Hire the Right Lawyer

The time following your car accident is critical to your recovery. Without a qualified personal injury lawyer, or the right injury lawyer on your side, you can make crucial mistakes that can prevent your from recovering the compensation you need for medical bills, lost wages, and other expenses.

Why You Need to Hire a Personal Injury Attorney

The importance of consulting with a personal injury attorney following a serious car accident seems self-evident, yet, many people think they can handle these complicated legal proceedings on their own. The 4 most common reasons people don't hire lawyers immediately following an accident are:

o They don't know if they need a lawyer;
o They don't know one personally;
o They don't know if they can trust a lawyer; and
o They believe the insurance companies that tell them lawyers will get them less money.

Most of the time, personal injury lawyers will take a percentage of your recovered compensation, but at the same time, that lawyer will also usually increase the amount of your recovered damages.

Given the mental, physical, and financial stresses that follow car accidents, hiring a personal injury lawyer is usually the last thing you want to do. Having your legal rights protected is definitely worth the effort and much less of a hassle than going after insurance companies on your own. A prior bad experience with an attorney is no reason to let an insurance company or negligent driver rob you of the compensation you are entitled to in order to pay for the expenses related to your car accident.

Not hiring an attorney in an effort to avoid legal fees is also a very bad idea. People representing themselves usually end up contacting an attorney when they realize they are in over their heads in paperwork and legal processes they don't understand. By that time, it is generally too late. There are many mistakes an uninformed person can make that could irreparably damage their case.

Insurance adjusters are only looking out for their bottom line and it is their job to get you to accept a settlement offer for the least amount of money possible. Hiring an experienced personal injury attorney is usually necessary to level the playing field because of the complexities of the legal system.

Hiring the Right Personal Injury Attorney

Every personal injury lawyer is different. Some take cases with the sole intention of settling the claim as quickly as possible and never taking it to court. Other firms will ask you to sign a contract with them - even if you have never even met the attorney.

Make sure to hire an attorney who will make your case a priority and who will take a personal interest in your claim by treating you with the respect, attention, and the dignity you deserve. The best way to find the right personal injury lawyer for you is to contact several in your area and set up a consultation (the best personal injury lawyers offer free consultations), where you can learn more about the lawyer and they can learn more about your case.

You must have confidence in the personal injury lawyer you hire to represent you. Hiring the right attorney will make all the difference in how you are treated and how your case is handled.

Best Car Accident Lawyers

In 2005, there were over six million reported motor vehicle accidents, and injuries related to them. The causes of these accidents range from cell phones, drunk drivers, running red lights, or even weather related causes. Every driver's worst fear is wrecking, and of course, the accident injury that goes hand in hand with it. No one wants to be cited, or even have their license suspended during these unfortunate accidents of course, but what if you're the victim? If this is your first motor vehicle accident, and hopefully it is, then you'll probably have no idea what to do!

The first thing you'll need to do is contact your insurance company, and inform them of this motor vehicle accident, inform them of any damage to the car, accident injuries, or even wrongful deaths if there were any. No doubt the aftermath of a car accident can be a traumatic time, but it is no time to lose your head. Think clearly, and remember everything you can about the accident, because your insurance company will need to know! The next thing you must do, is see if everyone else in the accident has insurance, and if someone doesn't, it's important to let the investigating police officer know, as that person should not be driving without insurance.

But what do you do after all is said and done? After everyone has gone home, the insurance companies have been called, and the citations have been written? The officer at the site of the crash said it was all over, but you don't feel fine. You're still shaking, realizing that you were lucky to have made it out alive! You'll feel this way for some time, and it's perfectly normal, however the best way to get some closure, is to make sure you get the compensation you deserve from the parties responsible for your plight. So how do you get this sort of compensation? Insurance companies can take ages to work things out, so the best way to speed up the process, is by hiring an attorney.

So now you know what you need to do, but how do you do it? The best place to start, is the yellow pages. Search for law firms in your area that specialize in this type of accident. If you don't have the money to pay for a lawyer, that might not be a problem, as some lawyers only accept payment if they win the case. This means that a portion of the money you obtain from your lawsuit, will go toward paying your lawyer in the event the ruling is in your favor, and if you were not at fault, then most likely you will win the case.

Another way to locate a lawyer, is through word of mouth, or by searching on the Internet. A simple Google or Yahoo search should turn up hundreds upon hundreds of results relating to accident attorneys, or lawyers in general, as well as information to help you get started with filing your claim. So now you know a few basic pointers on what to do if you're ever in an unfortunate accident. Just remember that the worst thing you can do is drive without insurance, as doing so will reduce your chances of a favorable outcome in the courtroom. Remember to get the best lawyer possible, and always dress your best when you enter the court. With a positive outlook, and a great lawyer, you're sure to get something for your troubles.

Lawsuit Loan - I've Been Involved in a Car Accident - Am I Eligible? (Part I)

Car accidents cost the lives of over 40,000 Americans every year? In addition to deaths, they cause an untold number of personal injuries each year.

Car accidents are one of the leading causes of injury and death in the United States. Unfortunately, these cases, while quite common, can be quite complex, involving not only personal injury law, but insurance law as well.

A lawsuit loan may be obtained while awaiting your settlement, fortunately. It is significant to note that car accidents often result in some of the largest personal injury awards.

To assist while a victim of a car accident is awaiting settlement, a lawsuit loan is often provided. There can be a great deal of frustration with these cases, having to deal with not only the driver of the vehicle that collided with your vehicle, resulting in both damage to your car and injury to you and, oftentimes, your passengers, but also the insurance adjuster.

A lawsuit loan is often necessary in such cases, merely due to the fact that the insurance carrier will strongly protest paying anything on your claim. Thus, such claims may be drawn out for long periods of time.

It is very important to remember that if you are in a car accident, it is important to stay calm. It is with a clear-head that you will be able to take appropriate steps.

Once you're confident that both you and your passengers are no longer in the path of oncoming vehicles, it is necessary for you to call the police. You must notify a reliable source, even in those cases involving no obvious injury, and calling the police is an excellent way to accomplish this.

It is important for you to keep in mind that a lawsuit loan will customarily only be provided to parties who are not at-fault. Prior to making any determination as to whether they will pay or deny a claim, the insurance carrier must determine who is at-fault. The police report will serve as a verifiable account in such instances.

Critical Car Accident Mistake #6 - You Were Not Honest Or Did Not Cooperate With Your Lawyer

If you have invested the time to contact and hire a personal injury attorney, it can only benefit you to be completely honest and cooperative throughout your working relationship. Failing to do either one of these things may hurt your personal injury case and can result in severely limiting your potential financial recovery.

Be Honest With Your Personal Injury Attorney

Once you file a personal injury claim and begin your case, the party you are filing against will begin to dig into your past. You must be completely honest with your personal injury attorney about everything, whether you believe it to be relevant or not.

Being absolutely honest with your lawyer regarding any inquires they make about your past is essential to building your case. Even if you think this information is embarrassing, please know that your lawyer is bound by a confidentiality agreement that prevents them from ever repeating information you share with them. That being said, there are certain factors that can damage your reputation and will most likely be used to test your credibility in court, such as:

o Past accidents;
o Past injuries;
o Past criminal history;
o Past drug or alcohol abuse.

If you are not honest with your attorney about your past behavior and your attorney is "ambushed" with this information by the opposing side in the middle of a trial, it can ruin your personal injury case.

Cooperate With Your Personal Injury Attorney

This is your P.I. claim, your case, and your recovery. Not cooperating with your personal injury attorney will do nothing but harm your chances of being awarded the compensation you need. There is no reason to sabotage your own case by being uncooperative.

Do not misrepresent your income. You will not be able to recover damages if you distort the amount of your actual income. The insurance adjusters working against you will be able to verify your income quite easily, through such means as your income tax returns. Cooperating with your attorney means helping him or her to file an honest claim.

Make your personal injury attorney aware of every doctor you see following the accident as well as every doctor you have seen in the past. Doctors that you have visited previously will have records of your past health, and these will most likely be uncovered. If you are claiming an injury was the direct result of an accident but past medical records show you already had a history of that ailment, the opposing side could use this information to deny your claim.

Finally, make yourself available to your personal injury lawyer. Don't change your contact information without telling your lawyer, after all; your lawyer cannot help you if they have no way to reach you.

Auto Accidents and Your Legal Rights in Los Angeles California

Have you been injured in an automobile accident? Do you know your rights now that you've been involved in an automobile accident? Your injuries may include brain injury, spinal cord injury, paralysis, skull fractures, temporary amnesia, back and shoulder injuries, disk injuries, leg, knee and foot injuries, and whiplash. You may have suffered internal injuries including a torn spleen, injured bowels, liver, kidneys, lungs and heart. It is important that you contact a reputable auto accident lawyer in Los Angeles, California, specializing in personal injury law, to protect your rights in your unique situation.

Did the car you were traveling in, belong to you? Was the car a rental vehicle? Was the car a taxicab? If the vehicle did not belong to you, and you were injured in that vehicle, it is vital evidence in your case, and must be preserved as such. How do you proceed in executing this task? A personal injury lawyer knows just what to do. Leave all the legalities in his capable hands; it's futile to fight your case by yourself. You need someone on your side to fight for your rights, and to prevent the insurance bullies from trying to deceive you by making you settle quickly with an insufficient payoff. Unscrupulous insurance companies use this strategy before you have had a chance to think about seeking legal representation for your case.

In many cases accidents happen as a result of defective manufacture; therefore the body of evidence is the actual vehicle-and that vehicle has to be examined closely by an expert for any and all clues as to what caused the accident. The vehicle should not be handled or otherwise tampered with by anybody after the fact. An experienced auto accident lawyer is able to handle this situation with ease.

While you are in the hospital, your ability to support your family the way in which they have become accustomed; is drastically reduced or may even come to a sudden halt. As well as the household bills, there are now additional bills, ambulance and/or air-evac bills, emergency surgery and surgeon's bills, including anesthesiologists and consultant's bills, not to mention the thousands of dollars it costs per day while you are receiving medical care in the hospital. Following discharge from the hospital, there will be physical therapy costs, pain management appointments, medication expense, specialist's fees, transportation costs, and constant calls and demands for overdue hospital bill payments. All of this, and more, while you are trying to reconstruct your life; trying to keep your family together, as well as worrying about the future and its, seemingly, bleak outlook.

Take a break from your worries, and consult an experienced auto accident attorney, ready to take your case, and fight for your rights. Your full recovery is paramount; your personal injury claim will be conducted in a most professional manner, thoroughly and with integrity.

Don't leave your future to chance; consult a personal injury lawyer in Los Angeles, California, who will fight for your rights to gain full recovery, and make certain that you and your family have a sound, financial future.

Dealing with Car Accidents

According to statistics, a car accident occurs every 10 minutes. This means that it could happen to you anytime if you're not careful. And if it does happen, be sure that you know what to do after it. The period that immediately follows car accidents is the most crucial so you should be prepared. Here are the things that you should do:

1. Call the authorities immediately.

Do not handle everything by yourself because this could lead to the worsening of the situation. Have authorities take care of it. The police will help settle the situation. They will also make a police report regarding the car accident that will identify who really is at fault. While waiting for the authorities to arrive, keep your cool to avoid any fights or arguments with the other party from ensuing.

2. Have yourself checked by a doctor.

Even if you think that you are perfect all right, go see a doctor as soon as possible. You might have some injuries that you are not aware of. There are instances when injuries and complications arise several weeks or months after the car accident.

3. Obtain as much information as you can about the incident.

By collecting a lot of information, you will help preserve evidence that may be harder to obtain later on or may even get lost. Here are some details that you may want to take note of:

a. Names and contact details of the other party

b. Names and contact details of the registered owners of the vehicle involved

c. Names and contact details of passengers

d. Names and contact details of witnesses, if any

e. Names and contact details of the authorities who responded to the situation

f. License number of the driver(s)

g. Insurance company and policy numbers of driver(s)

h. Location of the accident

i. How exactly the car accident took place

j. Description of all the damages to property and injuries to persons that happened

k. Your impression of the driver (i.e. under the influence of alcohol or drugs) and the reason for your impression (i.e. slurred speech, red eyes, etc.)

l. Photos of the scene, if you have a camera with you or if there's a nearby store where you can purchase a disposable camera. Take as many pictures as you can to get a more accurate representation of what happened.

4. Get skilled legal representation.

An experienced car accident lawyer will help you in dealing with all the parties involved - the drivers, authorities, witnesses, and insurance companies. Moreover, they will help you identify what damages you suffered from the accident and get the appropriate compensation for it.

5. Do not admit fault.

Never take responsibility for the accident and admit fault to anyone at the incident. The evidence recovered might prove later on that you are innocent.

If you follow the above tips, you will be ensured that the whole process after the car accident, from gathering information to getting your compensation, will run smoothly and be straightforward.

How Car Crash Lawyers Proceed With Liability Determination in Court

When a motorcycle accident case goes to court, the case is judged from different angles and a lot of points are considered before judgment. To prove the negligent conduct of the offender court checks whether the car or truck drivers, motorcycle riders and pedestrians, if any, involved in the accident complied with traffic laws or not. Court decides who was responsible for the accident after checking all the evidences, considering statements of eye witnesses and finally performing a comparative study of fault. At last the compensation amount is computed.

The actions taken in court can be broadly classified under following headings:

  1. Liability determination

  2. Compensating the victims

Liability determination is the process of determining who was responsible for the accident. A lot of drivers and motorcycle riders violate traffic rules while driving. Disobeying traffic rule does not necessarily fetch any penalty, however, if an accident happens because of the driver's fault OR rush driving results in injury for someone else, the driver is held responsible.

However, the process is not so easy. Most of the time both of the parties involved in the accident are responsible more or less. Hence, a comparative study is carried out to find out each party's share of responsibility. If both of them violated street laws and traffic rules then who was at bigger fault? A comparative responsibility study answers such questions.

There is no specific rule for conducting comparative liability study as all accident cases are unique in nature. One can hardly find similarities between two motorcycle accidents. That is why a thorough study of the situation is required to carry on the comparative liability study.

Accident vicims in Florida may see Florida lawyers. Competent Fort Lauderdale accident attorneys and personal injury lawyers sketch the plan of action in such a way that establishing the liability clause against the offender becomes easier. Once liability determination is done, the case becomes simpler.

Having liability determination done, personal injury lawyers focus on Compensation Evaluation. The objective is to help the victims get just compensation that satisfactorily fulfills all the requirements of the moment.

Common damages from motorcycle accident are:

Property damage: Motorcycle and vehicles involved in the accidents may get damaged. Valuable possessions may be spoiled or lost during the accident. All these details must be documented properly.

Personal Injuries: Victims or both the parties can be severely injured. Bone fracture, spinal cord injury, brain injury etc. are quite common in motorcycle accident. Victims may become permanently disabled if the accident was too harsh.

Wage Loss: With severe injuries it becomes difficult for the victims to go to work. Therefore reduced income, wage loss and unemployment are inevitable.

Physical and mental stress: Not only the victims, but their family members undergo huge mental pressure and stress because of the whole incident. These damages are counted during compensation evaluation. Florida personal injury lawyer knows how to get these damages counted.

Medical expenses: One needs to spend a lot on treatments after automobile accident. Total amount of expense may depend on the nature of injuries. Amount expended for treatment must be compensated by the guilty party.

Compromised lifestyle: Victims and their dependants are put in a compromised lifestyle physically and financially. This creates huge mental pressure that should be compensated by the offender.

Expert motorcycle accident attorneys present the case in most effective way so that all the damages are considered and counted properly while calculating compensation amount. Should you become victim of motorcycle accident, take help from professional personal injury lawyers to win your compensation claim lawsuit.

Six Essential Steps to Make Car Accident Claims Easier

When you're in a car accident you're pre-occupied with medical issues and the condition of your car. Am I alright? Is my car alright? Filing an accident claim is probably not going to be the most pressing issue for you after the accident. But if the vehicle damage is substantial, accident claims should be something you should focus on sooner rather than later.

Most people think that the accident claims process is complicated, but it's not if you follow these simple steps as soon as possible after the accident.

Step 1: Stay on the scene - Your version of the incident has to be told to the police for their police report. Do not, under any circumstances, except medical emergency, abandon the scene of the accident.

Step 2: Call the authorities - Inform police and medical facilities immediately. The police will examine the scene thoroughly and file a report. Note down the names of the officers. The ambulance team will take care of your injuries and recommend the course of action regarding going to the hospital or doctor. This is important information to note, for you, and when while filing any claims.

Step 3: Gather information - Remember to note the contact details of the other party involved and all witnesses of the accident. Record the license number, make and model, insurance information, VIN number, of the vehicles involved in the accident.

Step 4: Take photos, if possible - Photographs of the accident are excellent pieces of evidence when making a car accident claim. Even if the photos are from a mobile phone camera, and are not top quality, this will be very useful.

Step 5: Contact your insurance company/agent immediately - It is your responsibility and duty to inform your insurer about an accident as soon as possible after it takes place. Do not wait for them to contact you.

Step 6: Contact a car accident lawyer - An experienced lawyer is your most importantly in an accident claim. He is trained to deal with the insurance companies, third parties, and the law on your behalf. Get an expert - do not delay on this.
